Event Terms & Conditions

These Event Terms and Conditions (Terms) are between Rocco & Albie’s Limited, a company registered in England and Wales with Company Number 14200466 (we, us, our) and you or your, the ticket holder for an event run by us (Event).These Terms apply in addition to the SEE Tickets Terms and Conditions, available to view here: SEE Terms & Conditions. In the event of any inconsistency between these Terms and the SEE Terms, the SEE Terms will prevail.

 

1. Ticket Registration

      1. You may register for an Event as set out on the SEE Tickets website. You may register on your own behalf or on another attendee’s behalf if you have their consent to the registration and you have made them aware of these Terms.

      2. It is your responsibility to check the registration details, including selected ticket and ticket type, quantity of tickets, venue, time and pricing, before you submit your registration through the SEE website.

      3. The SEE Terms set out the process of delivery and/or collection of the tickets for the Event.

      4. We are only responsible for the inclusions of your selected ticket set out on the Event page of the SEE website or our website (as applicable).

      5. You acknowledge and agree that your ticket does not include any transport to or from the Event or any accommodation.

      6. There is a minimum purchase of one adult and one child ticket for an Event. We do not allow ticket purchases for adults without purchasing a child ticket, and children are not permitted to attend an Event without their parent or guardian, who must be over 18 years old. You will not be allowed entry to the Event unless there is at least one adult and one child in attendance at the Event. For the purposes of these Terms, a child will be considered under 16 years of age.

      7. You may purchase tickets for a private table, where indicated on the SEE website, where you will be seated with other ticket holders for whom you have purchased a ticket for. Where you are purchasing tickets for seats on a standard club table, you will be seated with other ticket holders that have purchased a ticket to the Event, based on availability.

      8. We cannot guarantee that you will be seated with specific ticket holders, unless you have purchased tickets in the same booking. Please contact us at enquiries@the-roc-kingclub.com for any requests.

      9. You must purchase or select a ticket for all attendees, including for children. Infants under 12 months of age will be entitled to a free ticket, but we require their registration for Event planning purposes. Infants will not be entitled to a meal with their free ticket.

      10. We may issue you with printed invitations as part of your purchase, which will be limited to one per booking. They are not required nor are they valid for entry to the Event.

2. Price and Payment

    1. The purchase of tickets for the Event is facilitated by SEE Tickets. Please refer to SEE Tickets website, including taking note of the price and currency. VAT is included in the price, unless otherwise specified.

    2. We reserve the right to increase or decrease the price of our tickets before they are purchased by you (for example, by offering various releases of tickets with different prices). Price changes will not affect any confirmed orders, except where there has been an obvious error or mistake.

3. Disclaimers

      1. Where applicable, any comments or opinions shared by a speaker, entertainer, or an Event sponsor are their own and do not represent our views or beliefs. Unless specifically mentioned, we neither endorse nor confirm their statements, including any recommendations or promotions they might offer.

      2. We cannot vouch for the accuracy of the information given by speakers, entertainers or sponsors during the Event. If you choose to rely on their words, we won't be held responsible for any consequences arising from such reliance.

      3. The Events aim to be dazzling and entertaining, so you can expect to see all types of performers and entertainers at the Event. There may be risks or hazards to children at the Event, including fire, strobe lighting, loud music and noises, and animals. Children must be supervised at all times while attending the Event, and you agree to comply with the directions of staff at the Event at all times, including for your own health or safety.

4. Changes, refunds and cancellations

Changes to programmes

      1. We reserve the right to change Event programmes or entertainment at any time. Every effort will be made to ensure programmes or entertainment are of an equivalent standard.

Errors on website

      1. We reserve the right to cancel a ticket registration, at any time before an Event, if the ticket registration was subject to an error on the SEE Tickets website (for example, in relation to an Event description or price). If an error occurs, we will contact you using the details you provided when you registered and we will endeavour to give you the option of purchasing the ticket at the correct price (if any) or provide you with a refund.

Ticketing mistake

      1. If you request us to reprocess your ticket(s) due to an error on your behalf, we may charge you any additional fees incurred in reprocessing your registration (including chargeback fees or other fees incurred by our payment provider).

Your cancellation

      1. We do not offer refunds for a change of mind, or for inclement weather where the Event is able to proceed.

      2. For further information about tickets and refunds (or to claim a refund in relation to a purchase), please contact customer services at enquiries@theroc-kingclub.com. Please provide your full order details including order reference, name, home address, phone number, and email address.

      3. TicketPlan Refund Protection covers visitors (subject to the terms and conditions of TicketPlan) who are unable to attend for various reasons. Details of which can be found here. In all instances, suitable supporting evidence will need to be provided.

 

Please note your booking will not be covered if The Roc-King Club is open, but you are unable to attend the event due to governmental advice or restrictions or similar circumstances outside of our control. TicketPlan fees are non-refundable in all circumstances including being unable to attend due to The Roc-King Club cancellation of the event.

Our cancellation

      1. If the Event you have purchased tickets for cannot go ahead or we are required to reduce the number of persons that can attend the Event or experience due to public health restrictions, we will automatically refund all ticket holders to the payment method used to purchase the tickets within a reasonable time of the cancellation.

      2. Unless required by law, we will not be liable for, or cover the costs, of any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an Event, including any travel and accommodation expenses. You must cover these yourself. We recommend you carefully consider the refund and cancellation policies of any travel, transport or accommodation you book in anticipation of attending an Event you have registered for on the website.

Refunds

      1. Where you are entitled to a refund for your ticket purchase under these Terms, SEE Tickets will manage the refund process. Please refer to the SEE Terms for more information on processing refunds.

5. Behaviour and Admission Terms

      1. By registering for an Event, you agree:

        1. to comply with these Terms and our reasonable requests and requirements;

        2. to present your tickets to our team at the Event in order to gain entry;

        3. to comply with the venue rules where the Event is hosted, and our applicable health and safety rules and any security requirements in place from time to time;

        4. if applicable, to inform us of your dietary requirements when purchasing tickets for the Event, or by emailing us more than 10 days prior to the start of the Event at food@roc-kingclub.com. If you do not to provide us with your dietary requirements, we will assume you have no dietary requirements;

        5. you will be considerate and respectful to all Event attendees and at related social events;

        6. you will not consume excessive amounts of alcohol or be under the influence of non-prescription drugs;

        7. we do not tolerate harassment, bullying or any other unacceptable behaviour;

        8. to always supervise your children at the Event;

        9. that you will not smoke or vape at the Event;

        10. that animals are not permitted at the Event (except service animals);

        11. to treat all staff and performers at the Event with respect;

        12. to hold all necessary insurances for your attendance of the Event, including travel insurance; and

        13. to not do anything that may put us, our business, our brand, or the Event into disrepute.

      2. You agree that we reserve the right to remove you from the Event if we or the Event hosts consider that your behaviour constitutes a breach of this clause or a breach of any other provision of these Terms. No refund will be due to you as a result of any unused portion of your ticket.

      3. You acknowledge and agree that the Event is subject to a strict timetable to allow our guests to experience the Event in full. You agree to arrive at the Event by the scheduled entry time. We reserve the right in our sole discretion to refuse or delay your entry into the Event where the performances have already started, for the safety of our guests and enjoyment of the performances. We will not be liable to you for any refund or discount on the ticket price where you are late to the Event and/or miss any part of the Event.

      4. You acknowledge and agree that purchases made at the Event may only be paid for with a valid debit or credit card, as we do not facilitate cash payments at the Event.

6. Resale of Tickets

      1. You agree not to offer tickets sold by us for resale or to use tickets for advertising, promotional or other commercial purposes, including trade promotions or competitions.

      1. If you sell a ticket, or it is used in breach of these Terms, we may cancel the validity of the ticket without refund to you, and the ticket holder may be refused admission to the relevant Event.

7. Intellectual Property

      1. You acknowledge and agree that all intellectual property in the Event including our logo, trademark, performances, music and event space vest, or remain vested, in us.

      1. We authorise you to use our materials solely for your personal use. You must not exploit our materials for any other purpose, nor allow, aid or facilitate such use by any third party. You may only access our materials on your personal device, and you may not use our materials for any commercial purpose.

      2. You acknowledge and agree that any intellectual property or content used at an Event by a performer or vendor/sponsor is owned or licensed by the relevant entertainer or vendor (Vendor’s Materials).

      3. You must not, without our, or the relevant performer or vendor/sponsor’s, prior written consent:

        1. copy, in whole or in part, any of our materials or a Vendor’s Materials;

        2. reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any of our materials or a Vendor’s Materials to any third party; or

      4. This clause will survive termination or expiry of these Terms.

8. Limitation of Liability

      1. Neither Party may benefit from the limitations and exclusions set out in this clause in respect of any liability arising from its deliberate default.

      2. Nothing in these Terms limits any liability which cannot legally be limited, including liability for:

        1. death or personal injury caused by negligence;

        2. fraud or fraudulent misrepresentation; and

        3. defective products under the Consumer Protection Act 1987.

      1. Despite anything to the contrary, to the maximum extent permitted by law:

        1. our maximum aggregate liability arising from or in connection with the Terms (including the Event and/or the subject matter of the Terms) will be limited to, and must not exceed, the portion of the price paid by you to us for the ticket the subject of the relevant claim, or where no price was paid, £50; and

        2. a party’s liability for any liability under these Terms will be reduced proportionately to the extent the relevant liability was caused or contributed to by the acts or omissions of the other party, including any failure by that other party to mitigate its loss.

      1. Despite anything to the contrary, to the maximum extent permitted by law, we will have no liability, and you release and discharge us from all liability, arising from or in connection with any:

        1. loss of, or damage to, any ticket, or any injury or loss to any person as a result of attending or not attending an Event;

        2. any third parties or any services or events provided by third parties, including hotels, partners, venues or other subcontractors which the provision of the events may be contingent on, or impacted by; or

        3. the website or an Event being unavailable;

        4. breach of the Terms or any law,

where caused or contributed to by any:

        1. event or circumstance beyond our reasonable control; or

        1. act or omission of you or your related parties, and, in any event, any defect, error, omission or lack of functionality or suitability (or the absence of, or reduction in, any anticipated result, outcome or benefit) with respect to the Event you purchase a ticket for.

      1. Despite anything to the contrary, to the maximum extent permitted by law, you are liable for and agree to indemnify, hold harmless, release and discharge, us in respect of any liability which we may suffer, incur or are otherwise liable for as a result of, or in connection with any loss or damage to any person or property at an Event that arises as a result of any negligent acts or omissions of you or people you have purchased a ticket for or where you (or a person you purchase a ticket for) refuse to follow our reasonable directions (including with regard to safety procedures).

9. General

  1. Assignment: You must not assign any rights or obligations under these Terms, whether in whole or in part, without our prior written consent.

  2. Force Majeure: To the maximum extent permitted by law, we will not be liable to you for any delay or failure to perform our obligations under these Terms if such delay or failure is caused or contributed to by any event or circumstance which is beyond our reasonable control including but not limited to, acts of God including fire, hurricane, typhoon, earthquake, landslide, tsunami, mudslide or other catastrophic natural disaster, civil riot, civil rebellion, revolution, terrorism, insurrection, militarily usurped power, act of sabotage, act of a public enemy, war (whether declared or not) or other like hostilities, ionising radiation, contamination by radioactivity, nuclear, chemical or biological contamination, any widespread illness, quarantine or government sanctioned ordinance or shutdown, pandemic (including COVID-19 and any variations or mutations to this disease or illness) or epidemic.

  3. Filming and Photographing Events: When attending our Events, we might take pictures or videos, and you might be in them. Unless you tell us otherwise, we can use these images or videos for promotional reasons, like on our social media. You won't be paid for this use. If you don’t want to be in the photos or videos, let us know in writing before the Event. If you want any of the official photos taken for your own personal (non-commercial) purposes, you can request them from us. We allow you to take photographs and videos at the Event, however video and flash photography is not allowed during performances or shows at the Event.

  4. Your Photographs: If you provide us with photographs of yourself at an Event, including via email or by tagging us on social media, you consent to us publishing such photographs and details (including but not limited to your name, location and date) for our marketing purposes including but not limited to on our website, in our social media, on our content sites and to supply to publishers covering the Event.

  5. Complaints: Although we endeavour to make sure that our guests have an enjoyable time at the Event, we acknowledge that occasionally things may not go to plan. Please contact us at info@theroc-kingclub.com and we will attempt to address the problem as soon as possible. Please provide us with as much detail as possible, including the name of your booking and date of the Event. You agree to contact us to allow us to resolve the issue prior to initiating any formal disputes process through alternative dispute resolution or the courts.

  6. Disputes: Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to contact the alternative dispute resolution provider we use. You can submit a complaint to The Centre for Effective Dispute Resolution via their website at https://www.cedr.com/. The Centre for Effective Dispute Resolution will not charge you for making a complaint and if you are not satisfied with the outcome you can still bring legal proceedings.

  7. Governing Law: These Terms are governed by the laws of England and Wales. Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in England and Wales and any courts entitled to hear appeals from those courts and waives any right to object to proceedings being brought in those courts.

  8. Privacy: We will only use your personal information as set out in our privacy notice. You can find our privacy notice here. You can also find SEE tickets privacy policy here.

  9. Entire Agreement: Subject to your consumer law rights, these Terms contain the entire understanding and agreement between you and us in respect of their subject matter. Each Party agrees that it will have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms.

  10. Contracts (Rights of Third Parties) Act 1999: Notwithstanding any other provision of these Terms, nothing in these Terms confers or is intended to confer any right to enforce any of its terms on any person who is not a party to it.

  11. Notices and Written Communications: When we need to communicate with you in writing we will use the email address that you provide us with. If you do not want us to communicate with you in writing by email, you must tell us. For any changes to your details, please contact us using the contact details at the start of these Terms. Any notice given under these Terms must be in writing addressed to the relevant address last notified by the recipient to the Parties. Any notice may be sent by standard post or email, and will be deemed to have been served on the expiry of 48 hours in the case of post, or at the time of transmission in the case of transmission by email.
